This essay explores some concerns about the quality of informed consent in patients whose autonomy is diminished by fatal illness. It argues that patients with diminished autonomy cannot give free and voluntary consent, and that recruitment of such patients as subjects in human experimentation exploits their vulnerability in a morally objectionable way. Two options are given to overcome this objection: (i) recruit only those patients who desire to contribute to medical knowledge, rather than gain access to experimental treatment, or (ii) (...) provide prospective subjects the choice to participate in standard doubleblind study or receive the experimental treatment. Either option would guarantee that patients in desperate conditions are given a more meaningful choice and a richer freedom, and thus a higher quality of informed consent, than under standard randomized trials. The making of music has been sufficiently deep and widespread diachronically and geographically to suggest a genetic imperative. C.G. Jung's 'Collective Unconscious' and the accompanying archetypes suggest that music is a psychic necessity because it is part of the brain structure. Therefore, the present view of aesthetics may need drastic revision, particularly on views of music as pleasure, ideas of disinterest, differences between so-called high and low art, cultural identity, cultural conditioning, and art-for-art's sake.All cultures, past and present, show evidence (...) of music making. Music qua music has been a part of human expression for at least some forty-thousand years and it could well be speculated that the making of music accompanied the arrival of the first human beings. As Curt Sachs states, "However far back we tracemankind, we fail to see the springing-up of music. Even the most primitive tribes are musically beyond the first attempts".Why do humans continuahy create music and include it as an integral part of culture? What is music's driving force? Why do cultures endow music with extraordinary powers? Why do human beings, individuahy and as societies, exercise preferences for specific works and genres of music? In probing these questions, I chose one aspect of Jungian psychology, that of the Collective Unconscious with its accompanying archetypes, as the basis upon which to speculate a world aesthetics of music. Once we dispense with the mechanistic and designer idea of human origins, we have only the investigations of the human psyche to mine for data that could explain the myriad forms of artistic activity found the world over. An examination of human beings, I believe, must lead one ultimately to the study of human behavior and motivations, in short, to the psychology of human ethos. This study wih take the following course: first, a discussion of consciousness and the Collective Unconscious, plus a discussion of archetypes; then, a description of musical archetypal substance; and finally, what I beheve is implied to form a world aesthetics of music.By comparison to Jung, Freud gives us little in the way of understanding artistic substance because for him, all artistic subject matter stems purely from the personal experiences of the artist. In comparing Freud and Jung, Stephen Larsen states that "Where Freud was deterministic, Jung was teleological; where Freud was historical, Jung was mythological". Jung drew on a much wider cross-cultural experiential and intellectual base than Freud. His interests in so-cahed primitive peoples led him to Tunis, the Saharan Desert, sub-Saharan Africa, and New Mexico in the United States to visit the Pueblo Indians; visits to India and Ceylon and studies of Chinese culture all contributed to his vast knowledge of human experience. Jung constructed the cohective unconscious as a major part of the psyche with the deepest sense of tradition and myth from around the world. He was criticized because of his interests in alchemy, astrology, divination, telepathy and clairvoyance, yoga, spiritualism, mediums and seances, fortunetelling, flying saucers, religious symbolism, visions, and dreams. But he approached these subjects as a scientist, investigating the human psyche and what these subjects revealed about mental process, particularly what might be learned about the collective unconsciousness. Jung's ideation, in my view, is sufficiently comprehensive to support the probe of a world aesthetics of music. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:A NOTE ON THE RELATION OF PACIFISM AND JUST-WAR THEORY: IS THERE A THOMISTIC CONVERGENCE? 1 GABRIEL PALMER-FERNANDEZ Youngstown State University Youngstown, Ohio FOR CENTURIES, the moral analysis of war began with a consideration of a set of principles which together form the doctrine of the just-war and with a rejection of pacifism. However, several recent studies by Catholic moralists argue that pacifism and just-war theory have much (...) in common and converge in at least one morally important way-namely, they share a presumption against violence. In this note I want to consider whether or not classical just-war theory gives us reason to accept this claim. I will give evidence against it, and suggest that the "original just-war question," as James Turner Johnson calls it, does not begin with aprohibitive presumption or some equivalent constraint on action. If we are to speak of a presumption in classical just-war theory, it is that justice be done for the sake of the common good. Up to very recent times, those Christian denominations which Ernst Troeltsch called the "church-type" (Lutheran, Anglican, Calvinist, and Roman Catholic) upheld a " two-tiered " or "double" morality. A "vocational" pacifism was required of clerical ranks, and the individual Christian was obligated to take up arms for the sake of the common good. For example, prior to the Second Vatican Council, Roman Catholic teaching on war rejected conscientious objection to all war (i.e., pacifism) as an option for Catholics. Manuals of moral theology prior to Vatican 1 I wish to acknowledge the very helpful and detailed comments provided by Richard B. Miller to an earlier version of this paper. 247 248 GABRIEL PALMER-FERNANDEZ II did prohibit the soldier from fighting in an unjust war and made room for subjective doubt about the justice of a particular war. But the consensus among Catholic theologians was both wide and deep. Pacifism for individual Christians did not have any moral-theological justification. It was, in fact, a grave moral error. In spite of this, Vatican II called for a " completely fresh reappraisal of war." 2 The policy of obliterating whole cities enacted during World War II, coupled with the development of nuclear and other indiscriminate weapons of destruction (e.g., incapacitating gases, biological weapons, etc.) and the instability of superpower relations, created an unprecedented condition for which traditional teachings on war seemed woefully inadequate, if not morally dangerous. A new, more far-reaching perspective was needed. And this was to allow for individuals the pacifist option as a second and complementary moral doctrine alongside traditional teaching on war.3 As the American Catholic bishops said in their pastoral letter on war and peace : 2 Pastoral Constitution on the Church in the Modern World, in A. The articles on ‘thinking’ by Gilbert Ryle brought together by Konstantin Kolenda were not very well received, even by those who acknowledge, as awhole generation of philosophers must, a considerable intellectual debt to him. Bernard Williams in his review ‘Ryle Remembered’ ) seemed to capture the general impression created by the book. My suspicion is that this was so because readers approached it with a resistance built up over years of hearingRyle flounder on the topic. They read the book expecting (...) to find nothing init that they had not already assimilated or rejected. To pick up the metaphor G. E. L. Owen employed in the obituary he wrote for the Aristotelian Society, they had come to regard Ryle's work as a philosophical seam which during his own lifetime had already been so extensively and profitably minedthat by the time of his death it was already producing diminishing returns. Although Williams in his review did provide a rationale for Ryle's floundering I suspect that his rationale, like most readers’ expectations, preventedhim from reading the articles in the volume at all closely. Williams's viewwas that towards the end of his life, with whatever he had had in the way of theory collapsing around him, Ryle was left with nothing but his massive common sense together with the resources of a style of writing which had bythen become a caricature of itself. As against this I shall argue that Ryle, puzzled by the notion of thinking, took the problem back to his own philosophical roots where he finally came to think that the solution lay. (shrink)

Explorations in Systems Phenomenology in Relation to Ontology, Hermeneutics and the Meta-dialectics of Design -/- SYNOPSIS A Phenomenological Analysis of Emergent Design is performed based on the foundations of General Schemas Theory. The concept of Sign Engineering is explored in terms of Hermeneutics, Dialectics, and Ontology in order to define Emergent Systems and Metasystems Engineering based on the concept of Meta-dialectics. -/- ABSTRACT Phenomenology, Ontology, Hermeneutics, and Dialectics will dominate our inquiry into the nature of the Emergent Design of the (...) System and its inverse dual, the Meta-system. This is an speculative dissertation that attempts to produce a philosophical, mathematical, and theoretical view of the nature of Systems Engineering Design. Emergent System Design, i.e., the design of yet unheard of and/or hitherto non-existent Systems and Metasystems is the focus. This study is a frontal assault on the hard problem of explaining how Engineering produces new things, rather than a repetition or reordering of concepts that already exist. In this work the philosophies of E. Husserl, A. Gurwitsch, M. Heidegger, J. Derrida, G. Deleuze, A. Badiou, G. Hegel, I. Kant and other Continental Philosophers are brought to bear on different aspects of how new technological systems come into existence through the midwifery of Systems Engineering. Sign Engineering is singled out as the most important aspect of Systems Engineering. We will build on the work of Pieter Wisse and extend his theory of Sign Engineering to define Meta-dialectics in the form of Quadralectics and then Pentalectics. Along the way the various ontological levels of Being are explored in conjunction with the discovery that the Quadralectic is related to the possibility of design primarily at the Third Meta-level of Being, called Hyper Being. Design Process is dependent upon the emergent possibilities that appear in Hyper Being. Hyper Being, termed by Heidegger as Being (Being crossed-out) and termed by Derrida as Differance, also appears as the widest space within the Design Field at the third meta-level of Being and therefore provides the most leverage that is needed to produce emergent effects. Hyper Being is where possibilities appear within our worldview. Possibility is necessary for emergent events to occur. Hyper Being possibilities are extended by Wild Being propensities to allow the embodiment of new things. We discuss how this philosophical background relates to meta-methods such as the Gurevich Abstract State Machine and the Wisse Metapattern methods, as well as real-time architectural design methods as described in the Integral Software Engineering Methodology. One aim of this research is to find the foundation for extending the ISEM methodology to become a general purpose Systems Design Methodology. Our purpose is also to bring these philosophical considerations into the practical realm by examining P. Bourdieu’s ideas on the relationship between theoretical and practical reason and M. de Certeau’s ideas on practice. The relationship between design and implementation is seen in terms of the Set/Mass conceptual opposition. General Schemas Theory is used as a way of critiquing the dependence of Set based mathematics as a basis for Design. The dissertation delineates a new foundation for Systems Engineering as Emergent Engineering based on General Schemas Theory, and provides an advanced theory of Design based on the understanding of the meta-levels of Being, particularly focusing upon the relationship between Hyper Being and Wild Being in the context of Pure and Process Being. As a result it iustified not only a historicist treatment but also a speculative discussion of its truth-content. These genuine philosophies may be nonetheless rooted in their own time as we all are, but in philosophy as in life (...) everybody is confronted with a decision whether he wants to be merely a part of history or whether he wants to have history, i.e. also to have the link with true being. Pareyson's theory of interpretation is specially tailored to the reconciliation of the multiplicity of philosophies and of the unity of philosophical thought, aiming at ontological truth. All philosophies are personal interpretations of the world, yet they have an indestructible content of ontological truth that surpasses their own time. We shall not err if we compare Pareyson's interpretation with what Joseph Scbelling called "intelektuelle Anschauung," i.e. the intuitive penetration of what he called the Absolute. Pareyson protests also against the claims of the humanistic sciences, such as sociology, anthropology and cultural history, to replace philosophy. All these sciences canhot replace the function of philosophy as described above. Pareyson uses a very illuminating metaphor: interpreting truth is like interpreting a musical score. While any such interpretation may be legitimate, all may be different and all are personal. But the musical score is always the same. The musical score is compared here with the ontological truth of philosophical thought, while the various readings of the score are the various historical philosophies. (Springfield, Ill., Thomas, 1968) In the last twenty years our ethics textbooks have been modeled upon the topics of normative and critical ethics. Eventually one finds appended to these main subjects discussions on moral determinism and relativism. While the former problem continues to foster much rigorous scholarship, both substantive and analytic, the germane issue of relativism has been seldom set forth today in a clear and convincing fashion. The fleeting recognition the problem receives in our textbooks renders homage to the curiosity of the student rather than encourages research in the origin, variability and validity of moral ideas,x The several articles 2 of any philosophical impact written after A. Edel essayed refutation of Westermarck's relativity thesis by appealing to invariant factors in the social sciences, fare no better. In spite of the labours of Sedlmayer,1 Ehwald2 and Palmer,3 it cannot be said that there exists a completely satisfactory edition of Ovid's Heroides. One or all of these editors sometimes leave a corrupted text, sometimes adhere too closely to a manuscript reading, and sometimes introduce untenable emendations. A new edition is called for, with revised collati ons of the known manuscripts, and an augmented apparatus criticus, exhibiting the large class of what I may term the ‘Vulgate’ manuscripts, which (...) represents a tradition different from, and probably later than that of our chief authority, the excellent but unfortunately incomplete eleventh-century Parisinus , which, like all primary manuscripts of this type, contains many readings or corruptions which should not on account of its mere authority be accepted slavishly. Light is often thrown on the text from less important sources, and the truth may be recovered from manuscripts of the ‘Vulgate’ family, where our better authority fails. In this connexion the study of my own manuscript has led me to some conclusions in certain passages which I venture to set forth as suggestions towards an improved constitution of the text of the Heroides. Though it is clear from the preceding investigation into its nature that O is no primary manuscript, but belongs rather to that large class which has passed through various stages of reproduction involving alterations due either to carelessness of copyists or, more rarely, to deliberate alteration, it presents at the same time a phenomenon not unusual with such manuscripts, inasmuch as it often supports the best tradition, and in some cases preserves a reading which yields the truth, or from which the truth can be elucidated. In the article, the analysis and philosophical explication of a phenomenon of values as synergetic determinants of culture and cultural-historical process, which is culturogenic development of the person and of his subjective being in socio-cultural space and historical time, is presented. The analysis is carried out on the basis of complex methodology having the synergetic approach as its main part. According to it, the semantic interpretation of a phenomenon of values and axiological understanding of culture as the system, which is (...) self-organized on the basis of values, and human history as the cultural-historical process positioning and approving human being in the world, are offered and proved. The human history is considered as a cultural artifact embodying evolutions and changes of conditions of the culturogenic attitude of the person towards reality. It is offered to consider axiology, the philosophical theory of values as the humanitarian doctrine about value development, assimilation of available reality by the person-subject. The modern importance and relevance of an axiology, which during the era of globalization of cultural-historical process becomes area of knowledge connected with definition of reference points and priorities of existence and development of the modern world, is noted. Battin et al examined data on deaths from physician-assisted suicide in Oregon and on PAS and voluntary euthanasia in The Netherlands. This paper reviews the methodology used in their examination and questions the conclusions drawn from it—namely, that there is for the most part ‘no evidence of heightened risk’ to vulnerable people from the legalisation of PAS or VE. This critique focuses on the evidence about PAS in Oregon. It suggests that vulnerability to PAS cannot be categorised simply by reference (...) to race, gender or other socioeconomic status and that the impetus to seek PAS derives from factors, including emotional state, reactions to loss, personality type and situation and possibly to PAS contagion, all factors that apply across the social spectrum. It also argues, on the basis of official reports from the Oregon Health Department on the working of the Oregon Death with Dignity Act since 2008, that, contrary to the conclusions drawn by Battin et al, the highest resort to PAS in Oregon is among the elderly and, on the basis of research published since Battin et al reported, that there is reason to believe that some terminally ill patients in Oregon are taking their own lives with lethal drugs supplied by doctors despite having had depression at the time when they were assessed and cleared for PAS.
